The Ministry of Public Security is the governing department of information security protection system in China. The Ministry is entrusted by the Chinese government to take charge of the supervision and management of information system security through the Act on ¡§Protection Legislation of Computer Information System Security of China¡¨.

The State Information Centre, P.R. China, which belongs to the State Planning Committee, is one of the largest departments providing information management and services in China. The Centre takes charge of the National Economic Information System which is a huge information system that combines economic analysis, information service and modern computer networks into one unit.

THE PROTECTION LEGISLATION-
ON COMPUTER INFORMATION SYSTEM SECURITY OF CHINA
The Ministry of Public Security is empowered to control and set standards on information security products in China. The Protection Legislation of Computer Information System Security of China was formally enacted by Mr. Tao Si Ju, the Minister of Public Security, on 12 December, 1997. Under the legislation, all products must first be evaluated at the MPS¡¦s testing facility in Tianjin and approval license must be obtained before distribution.

The Legislation covers the areas of general rules and regulations, the application and approval procedures, testing guidelines, testing on the information security products, the approval and granting of sales license and the penalties for violation of the regulations.

Computer information security system products is defined as all the software and hardware for the protection of information security system as outlined in Chapter 1 of the legislation. All these products must receive a sales license before they can be distributed in China. Products must be submitted for inspection testing at authorized testing centres before granting of the sales license.

Procedures of the testing of information security products are outlined in Chapter 3. All domestic manufacturers should send their products to an authorised organisation for testing. Foreign manufacturers should appoint a legal organisation or governmental department in China to submit their products for testing.

As described in Chapter 5 of the legislation, companies selling their products in China without obtaining valid license will be violating the law and will be subjected to administrative penalties. Municipal departments of public security have the power to prosecute and issue verdict on the violation.

The Ministry of Public Security, as a gatekeeper of the computer information security industry, will regularly announce the testing result of products and the list of qualified products being approved to be sold in China.
