LETS 2009 CALL FOR PAPERS
Background information:
Most international economic studies have indicated that the predominance of the major industrial countries over the developing countries is connected to their adoption of the new digital economy principles based on information technology and communication, taking into consideration that the information sector has become the main infrastructure for all industries and commercial activities and even for electronic government services (known as E-Government in major industrial communities). This has shown an improvement in the economic and social wheel of these economies making it impossible for the economies in the Arab world to keep pace with this developmental economic progress and creating what is known as the “digital gap” between the major industrial countries and the developing countries.
Periodical international digital summits were only held to confirm the importance of keeping up the efforts made by all parties – including international and regional organizations, governments and the private sector – to spread awareness on the nature and significance of the “cognitive or digital” community in the developing economies on one hand and on the development and activation of the process of orientation towards the information sector to be adopted by the public and private sectors in all the domains of life on the other hand, in view of creating an integrated digital community to serve and promote the ever-existing development issue. However, many efforts were definitely exerted by many countries at the Arab and western levels towards developing electronic transaction under the supervision of international organizations and governments. Nevertheless, there still exists a major legal gap between the reality of automation and the reality of legal progress with regard to both organization and legislation. This gap is greatly witnessed in the Arab world since there is a big lack of any laws that regulate safe electronic transactions – except for few laws concerning “electronic signature” – in several sectors particularly in finance, investment, health and security. Also, there is a big lack of unified legal orientation and guidance that corresponds and complements the Arab laws in force.
Thus, the situation in developing countries requires a quality leap in establishing legislations and regulatory circumstances for electronic transactions, aiming at keeping pace with development and modernity and catching up with the fast transformations affecting the different aspects of our lives which have been penetrated by the electronic transactions such as the know-how acquisition and promotion, social interaction, economic and social activities, media, education and culture, health and environment, entertainment and amusement in addition to the political, administrative and service operations and preservation of social security.
In the light of the aforementioned data and challenges, this Forum takes place to form the scientific and legal platform for specialists and experts to put forth the advanced and Arab experiences as a basis, opening a doorway towards efficient participation in common efforts to find a unified Arab law which shall constitute a quality leap towards filling the digital gap between the Arab economies and its international counterparts especially that commerce and transactions went beyond the Arab geographical frames.
Objectives:
The Forum aims at:
1. Increasing the Arab region’s capacity to benefit from electronic transactions by establishing legislative structures and regulatory frames necessary for building the State and a modern electronic administration and executing the E-government project by:

Placing the proper mechanisms to coordinate between the legislative institutions in the Arab countries concerning the electronic transactions and between the citizens of the Arab countries in all domains to preserve their rights and legal obligations;

Seeking to unify the concepts and terms related to electronic transactions in the Arab countries for judicial and arbitrary purposes under the supervision of the League of Arab States;

Subjecting the existing and new regulatory and administrative concepts and suggestions related to electronic transactions, to the legal controls and principles that guarantee equal rights to all the parties of the transactions in the Arab countries;

Establishing legal bases that guarantee the smooth flow of investments and the provision of citizens’ needs through electronic transactions in all the known domains of life in both the public and private sectors in the Arab countries to easily guarantee the rights of all the parties of the transactions at the same legal level.
2. Increasing opportunities of investment and merger in the international digital economy by developing and supporting the electronic activities in the private sector, particularly in the commercial sector and the banking and financial sectors, through finding judicially approved (guidance) forms for the electronic transaction documents issued in all the Arab courts as well as their commercial, economic, social, cultural and security transactions with other countries;
3. Providing the proper legislative environment that will lead to social security, stand in the way of all kinds of electronic crimes and limit crimes, frauds and violations, and seek to find the proper similar penalties in the Arab countries. This will guarantee the rights of the parties of the transaction and prevent exploitation and legal evasion within our Arabic economies;
4. Finding incentive legislations to build an Arab digital community in all its aspects as well as to put an end to poverty and improve the quality of life;
5. Establishing policies to manage the Internet mechanism aiming at developing the content of the Arab Internet and providing safe communication structures to guarantee information security;
6. Seeking to support the electronic legal aspect of the professional level of the judges, attorneys and public prosecutors (public prosecution) through sessions, seminars, forums, researches, studies and exchanged information to confront the criminal methods and means using the electronic transactions in the Arab countries.

1- The legal nature of the Arab electronic transactions: problems and proposed solutions

• The administrative law view in the Arab countries with regard to controlling the various government dealings through the electronic management with individuals (citizens and expatriates)
• The role of the Arab commercial laws in controlling regional and international e-commerce transactions
• Arab investment laws and the support they provide to e-commerce dealings at the regional and international levels
• The extent of the evidentiary value of electronic dealings before the Arab courts of law
• The legal nature of the electronic court judgments in the Arab countries

Speakers of this Forum include professors of law, counselors, lawyers, arbitrators, judges, organizations, administration and re-structuring experts, specialized decision makers in the public and private sectors in the Arab World, GCC countries, Europe and the USA. Also, there will be a big involvement of a number of international organizations to share their experience in this field and discuss the latest developments and highlight the impediments of implementing the legal framework of electronic dealings
II. Workshops:
For more benefits of this event, LETS program will include THREE workshops on the last day.

Workshop one: Legislative overview on electronic transactions in HEALTH sectors.

Workshop two: Legislative overview on electronic transactions in BANKING sectors.

III. Exhibition:
Simultaneously with the Forum, there will be an exhibition on the latest technologies used in electronic dealings in addition to the intellectual trends of counselors, lawyers, judges and organization and administration officers in this regard.
IV. Discussion groups:
Discussion groups will discuss all the objectives of the Forum, prepare a draft recommendation for the methods and means of controlling electronic transactions. Also, they will recommend ways to develop and to protect rights, properties and investments in the Arab countries on an equal basis before the law.

Call for papers
Interested speakers are invited to submit papers that should include studies, ideas, experiences, and/or analysis on any of the suggested conference topics.
Authors who wish to present a paper are invited to send to the Scientific Committee of LETS 2009 an abstract not exceeding 300 words in accordance with the attached synopsis form.
Papers should be submitted in A4 standard size and a copy on CD.
