Disease management may be the "final frontier" in cost control, yet many employers and third party administrators have overlooked the significant legal compliance issues that may arise in connection with implementing a successful disease management program. Hidden compliance costs associated with disease management "carrots" and "sticks" need to be considered.

LEARNING OBJECTIVES
The rules do not prevent the establishment of wellness and disease management programs. They simply create hurdles which require sufficient knowledge in order to effectively navigate around or over such hurdles. Thus, the learning objectives are to identify and address the legal compliance issues so that legal compliance problems can be avoided and/or to identify creative solutions in the event legal compliance problems already exist.
