Description
This seminar will address procedural issues arising from administrative proceedings before the Commission concerning state aid, such as the right of interested parties to participate and be heard. It will also examine procedural aspects of the judicial review proceedings in the European Courts, such as the standing and possibilities for interested parties to intervene.
The seminar will also focus on procedural aspects of enforcement of EU state aid law in national judicial and administrative proceedings. It will discuss the conditions governing the recovery of unlawful or misused state aid and private enforcement of state aid rules. It will discuss actions by competitors for damages, recovery or injunctive measures.
Other issues on the agenda will be the minimum requirements on national remedies and procedures set by EC law through the principle of effectiveness, such as what remedies should be available for infringement of state aid law and Community law's impact on evidence rules, time-limits and rules on res judicata.
